No. 29 CHC Rejected C.R.M.(A) 5362 of 2023 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Kushmandi Police Station Case No. 168 of 2023 dated 10.07.2023 under Sections 447/325/326/354/307/34 of the Indian Penal Code, 1860.

And In the matter of : Sahirul Islam & anr.

...... petitioners Ms. Sahina Khatun ....for the petitioners Mr. Arijit Ganguly, Mr. Asraf Mandal ....for the State Petitioners pray for anticipatory bail.

Two of the injured, in the incident of assault suffered grievous hurt. One received two fracture injuries one of which over the scalp.

Petitioners before us stand implicated in the incident of such assault.

In such circumstances, notwithstanding police filing charge-sheet, we are unable to grant anticipatory bail to the petitioners.

This application for anticipatory bail is, thus, rejected. CRM(A) 5362 of 2023 is disposed of.
