This is an application for a direction upon the Trial Court for expeditious disposal of GR Case No. 1266/2015 arising out of English Bazar Police Station Case No. 235/2015 dated 21.04.2015 under Sections 302/34 of the Indian Penal Code pending before the learned Chief Judicial Magistrate at Malda. It is submitted on behalf of the petitioner who is in custody that in spite of submission of chargesheet on 29th July, 2019 the case has not been committed as yet by the learned Chief Judicial Magistrate, Malda to the Court of Sessions for trial. He also draws my attention to an order dated 30th September, 2022 where the Division Bench of this Court while rejecting the application for bail of the accused directed the Trial Court to take steps to commit the case to the Court of Sessions at the earliest. The said order was also violated.

The learned Chief Judicial Magistrate is directed to commit the case positively within three weeks from the date of communication of this order.

The petitioner is at liberty to act on the server copy of this order.
