(A) 4200 of 2024 In Re: An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Khanakul P.S. Case No.191 of 2024 dated 25.04.2024 under Sections 341/325/326/387/504/506/34 of the Indian Penal Code. In Re: Dipen Maity & Anr.
... ... Petitioners Mr. Niladri Sekhar Ghosh, Mr. Labani Sikder, Mr. Souvik Dey.
... ... for the petitioners Mr. Joydeep Biswas, Ms. Rajashree Tah.
... ... for the State 1.
Petitioners submit victim suffered injury due to road traffic accident and he has been falsely implicated. On such score, coaccused has been enlarged on regular bail. Accordingly, they pray for anticipatory bail.
2.
Learned Advocate for the State opposes the prayer for anticipatory bail.
3.
We have considered the materials on record. Statements of witnesses show victim was indiscriminately assaulted by petitioners resulting in head injury. He was taken to hospital where it is recorded he suffered a road traffic accident. However, in the subsequent medical report prepared on the same date, it is noted he was subjected to assault by his friends. The nature of injuries are grievous and supports the ocular version of witnesses.
4.
Hence, we are not inclined to grant anticipatory bail to the petitioners.
