No.35 (Aritra) (Allowed) In Re:- An application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, filed in connection with Sealdah GRPS Case No.6/2025 dated 17/01/2025 under Sections 20(b)(ii)(c)/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985.
And In the matter of : Altab Hossain @ Altaf Hosen ... Petitioner Mr. Prajnadeepta Roy Mr. Sabir Ali Mr. Debojyoti Goswami ....for the petitioner Mr. Ranadeb Sengupta Ms. Suchismita Dutta ....for the State Learned advocate appearing for the petitioner submits that petitioner is in custody for about 329 days and the accusations are that 22.550 kgs. of 'ganja' were recovered from the petitioner and another.
Learned advocate for the State opposes the prayer for bail and submits that investigation has already been concluded, charges have been framed and prosecution will expedite to conclude the trial of the case.
Be that as it may, having regard to the period of detention of the petitioner I am not inclined to detain the petitioner further.
Accordingly, the prayer for bail of the petitioner is allowed.
Petitioner shall furnish bond of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Additional District & Sessions Judge, 12th Court Alipore, South 24-Parganas (Special Court under NDPS Act).
If on bail, the petitioner shall be physically present on each and every date before the learned trial Court in seisin of the case. The petitioner shall not leave the jurisdiction of district of South 24-Parganas without the prior permission of the learned Special Court.
Accordingly, CRM (NDPS) 1601 of 2025 is allowed. All parties shall act in terms of server copy of this order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
