The petitioner is aggrieved by the fact that the private respondents have raised construction without obtaining sanctioned plan from the concerned authority.
It appears from the report submitted by the Panchayat that upon holding inspection and measurement of the plot in question, sanction for raising construction was granted in favour of the private respondents under Section 23 of the West Bengal Panchayat Act. The private respondents deposited the requisite fees for such construction following which plan approval was also granted.
In view of the above, this Court is inclined to hold that nothing further remains to be decided in the writ petition. The same is accordingly disposed of.
There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
