1. The parties made attempt to settle the disputes. What remains is a monetary claim. The respondent no.3 has claimed a sum of Rs.6.5 lakhs. The management has not agreed to the same. Both the workman and the representative of the Management, namely, Mr. Amit Bose and Mr. Sourav Jati are respectively are present in Court.

2. The workman has agreed to accept a sum of Rs.5,00,000/- as full and final settlement of all the claims against the Management.

3. This Court has prevailed upon the Management and its representative to agree to the same. The representative of the Management albeit with some reluctance has agreed.

4. In the interest of justice and with a view to end a litigation that is likely to prolong if not settled today,

let all the claims including the gratuity of the workman arising out of the impugned proceedings being Case No. 45 of 2015 under Section 2A2 of the Industrial Disputes Act, 1947 be settled and disposed of, upon payment of a sum of Rs.5,00,000/- by the writ petitioner to the respondent workman.

5. The payment shall be made in two several instalments of Rs.2.5 lakhs each. The first of such instalment shall be payable by 25th December, 2023. The second instalment for balance sum of Rs.2.5 lakhs shall be paid by 20th January, 2024.

6. It is reiterated that upon payment of the above, neither parties i.e. the writ petitioner or the workman shall have any claim whatsoever against one and another and all the disputes and differences shall come to an end and be set to rest.

7. With the aforesaid observations, the instant writ petition shall stand disposed of.

8. There will be no order as to costs.

9. All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
