Petitioner is aggrieved by the fact that in spite of registration of the case being Thanarpara Police Station Case No.213 of 2024 dated 05.08.2024 the investigation of the case is not progressing and since materials have not been collected in proper mode and manner, the accused persons have been released on bail.

Be that as it may, I have perused the report submitted by the State. Report reflects that the police authorities have collected the photocopies of the gift deeds which were produced by the accused persons

in course of investigation. The investigating officer has already submitted requisition to the ADSR, Karimpur for collection of the details relating to the transfer in respect of the property.

Learned advocate appearing for the private respondents submits that they have cooperated with the investigation and they have already been released on bail.

The domain of the court do not extend for directing the investigation to be concluded within a short span of time until and unless it reflects that the police authorities are purposely delaying the investigation of the case. In this case, police authorities have already made requisition to the ADSR, Karimpur for ascertaining regarding the manner in which the land has been transferred. It may be that the police authorities would require to cross-check the signatures also as there are allegations of forgery. Consequently, at this stage, it would be very difficult for the police to give a timeline within which the investigation is to be completed. However, the police authorities would take effective steps so that within the reasonable period of time the investigation can be taken to its logical conclusion. With the aforesaid observations, WPA 28438 of 2024 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
