Md Motasim Billah @ Rintu v. State Of West Bengal
08/01/2026 D/L - 22 Court No.28 S. Kundu Rejected C.R.M.(A) 4188 of 2025 In Re: An application for anticipatory bail under Section 482 of the BNSS, 2023. In connection with Hatishala P.S case no. 100 of 2025 dated 9/5/2025 under Sections 319(2)/318(4)/338/336(3)/340(2)/61(2) of the BNS. In the matter of: Md. Motasim Billah @ Rintu
...Petitioner.
Mr. Biswajit Hazra Mr. Syed Masud Kabir Mr. Archisman Sain Mr. Sk. Nadeem Ahmed ...for the petitioner.
Mr. Saibal Bapuli Mr. Dipankar Paramanick ...for the State.
1. Learned counsel appearing on behalf of the petitioner submits as follows. The de-facto complainant and his associates wanted to purchase the land. It is alleged that a person impersonated the owner of the land and took money from them. Seven cheques were encashed, but the property was never delivered. The petitioner has been falsely implicated in this case.
2. Learned counsel appearing for the State strongly opposes the prayer for anticipatory bail. He submits that the petitioner is a fraudster and there are several other criminal antecedents against him. He himself received a sum of Rs.11.5 Lakhs from the fraudulent transactions in this case. Reliance is placed on statements of witnesses as well as copies of the bank statements.
3. Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case to grant anticipatory bail to the petitioner.
4. Accordingly, the application for anticipatory bail is rejected.
