05/01/2026 M/L - 46 Court No.28 S. Kundu Rejected C.R.M.(A) 4191 of 2025 In Re: An application for anticipatory bail under Section 482 of the BNSS, 2023. In connection with Berhampore P.S case no. 2280 of 2025 dated 26/10/2025 under Sections 109(1)/117(2)/118(1)/3(5)/85 of the BNS. In the matter of: Ashim Sarkar @ Asim Sarkar

...Petitioner.

Mr. Somnath Adhikary ...for the petitioner.

Mr. Asraf Mondal ...for the de-facto complainant.

Mr. Anupam Das Adhikary Mr. Abhinaba Mukherjee ...for the State.

1. Learned counsel appearing for the petitioner submits that the alleged incident took place after 21 years of marriage. The petitioner is the husband of the alleged victim. All other co-accused were granted anticipatory bail.

2. Learned counsel appearing for the de-facto complainant strongly opposes the prayer for anticipatory bail.

3. Learned counsel appearing for the State relies on the statements of witnesses including that of the daughter of the petitioner and the victim and the injury report and the seizure list.

4. As per the daughter, she saw that there was burn injury on her mother and her father was trying to prevent her mother from dousing the fire.

5. Considering the above, the other materials available in the case diary and the injury report, I do not consider this to be a fit case to grant anticipatory bail to the petitioner.

6. Accordingly, the application for anticipatory bail is rejected.
