Mr. Bhagabat Chowdhury ...for the petitioner Mr. Pantu Deb Roy Mr. Subrata Guha Biswas ...for the State It is contended on behalf of the petitioner that the petitioner's earlier application for grant of permanent contract carriage permit (Auto Rickshaw) in the route Gariahat to Behala was turned down on the ground that there was no vacancy in the said route.

Learned counsel for the petitioner submits that by a subsequent notification dated March 31, 2017, the fleet strength has been increased by the authority. The petitioner submitted a further representation before the authority pursuant to the said notification but was informed by an order dated November 11, 2022 that the application would be considered only when further vacancy arose.

Learned counsel for the respondents seeks to submit a report in the form of affidavit in this matter. Let this matter appear under the same heading on January 19, 2024.
