1. Learned counsel appearing for the petitioners submits as follows. The petitioners are the husband and the brotherin-law of the alleged victim. The marriage took place four years ago. On the particular day, the victim actually had an altercation with her own father and thereafter committed suicide. The petitioner no. 2 stays separately.
2. Learned counsel appearing for the State opposes the prayer for anticipatory bail. He refers to the statements of witnesses, especially those of neighbours, who implicate the present petitioners and to the post-mortem report. Charge-sheet has been submitted.
3. Considering the above, the other materials available in the case diary and the alleged roles ascribed to the each of the present petitioners, while I am inclined to grant
anticipatory bail to the petitioner no. 2 (Rakib Miya @ Nur Alom Mia), the application for anticipatory bail of the petitioner no. 1 is rejected.
4. In the event of arrest, the petitioner no. 2 shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to further conditions that the said petitioner shall not threaten or intimidate witnesses. The said petitioner shall surrender before the learned jurisdictional Court and pray for bail within four weeks from date.
5. Accordingly, the application for anticipatory bail is allowed-in-part.
6. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
