20.02.2025 rc/ct.no.34 Item No.43 CRR No. 5019 of 2024 In the matter of : Sanju Kundu .......Petitioner Mr. Santanu Talukdar Mr. Priyankar Ganguly Ms. Shalini Bairagi ...for the Petitioner The petitioner has assailed the order dated December 22, 2023 passed by the learned Judge, Special Court (POCSO Act), Berhampore, Murshidabad in connection with C. Special Case No. 66 of 2019 directing issuance of warrant of arrest against him. It appears that the petitioner was granted bail initially and failed to appear before the learned Trial Court on two occasions for which warrant of arrest was issued against him by the order impugned. The petitioner undertakes to surrender before the learned trial Court within 7 days from date. If the petitioner surrenders before the learned trial Court within 7 days from date and prays for bail, the learned trial Court shall deal with the same in accordance with law.

In the event the petitioner fails to surrender before the learned trial Court within the stipulated time frame, the learned trial Court shall be at liberty to take necessary steps against the petitioner in accordance with law without further reference to this Court.

The warrant of arrest issued vide an order dated December 22, 2023 passed by the learned Judge, Special Court (POCSO

Act), Berhampore, Murshidabad in connection with C. Special Case No. 66 of 2019 be stayed till March 03, 2025. CRR No. 5019 of 2024 is disposed of accordingly. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
