Amicus Curiae ... for the appellant Mr. Avishek Sinha ... for the State The instant appeal was preferred against judgment and order of conviction dated 08.09.2008 passed by the learned Additional Sessions Judge, 3rd Fast Track Court, Malda in Sessions Case No. 56 of 2007 convicting the appellant under Section 14(A)(b) of the Foreigners Act amended in 2004.

The report of the Habibpur Police Station, Malda dated 06.08.2023 stated that the appellant had served out the sentence and was repatriated to his home country Bangladesh on 08.07.2011 and the said information was officially documented under Habibpur P.S. Genral Diary Entry No. 227 dated 05.08.2023. On an assessment of the evidence on record as well as the perusal of the impugned judgment, this Court is not inclined to interfere with the same.

Accordingly, the instant appeal is dismissed. Lower Court records be sent down to the learned trial court. Copy of the order be sent to the Department as well as trial court for due compliance.
