AD 50 January 05, 2026 Ct. 28 RANJAN CRM(A) 4195 of 2025 Rejected An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Baishnabnagar P.S. Case No. 37 of 2024 dated 11.01.2024 under Sections 21(c)/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Learned counsel appearing on behalf of the petitioner submits that till date no narcotic substance has been recovered from the possession of the petitioner. Apart from the statement of co-accused there is no other incriminating material available in the case diary against the present petitioner.

Learned counsel for the State relied upon the report, which is taken on record and vehemently opposes the prayer for anticipatory bail. According to him, WP & A has already been completed against the present petitioner on 07.11.2025. Phone call details of the present petitioner could not be obtained.

It appears that the FIR was registered long back on 11.01.2024 and in the meantime a proclamation has already been issued.

Considering the above and the other incriminating materials available in the case diary, I am not inclined to grant anticipatory bail to the present petitioner Emadul Sk. alias Endadul Sk.

The application for anticipatory bail is, thus, rejected. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
