Mr. Bhaskar Manna ..for the Petitioners Mr. Diptendu Narayan Banerjee Mr. Bhaskar Chakraborty ....for the State Affidavit of service filed by the petitioners and report filed by the State are taken on record. Heard learned counsels for the parties.

The petitioners claim to be the bargadars in respect of the land in question and submit that the private respondents are raiyats therein. The petitioners seek police assistance for harvesting paddy in the said land.

Learned counsel for the State submits that the dispute is civil in nature and the police is keeping a close watch over the area. Pursuant to the complaint lodged by the petitioner, the police has held enquiry and has submitted prosecution under Section 126 of the BNSS.

The dispute between the parties is civil in nature. The petitioners are at liberty to approach the appropriate forum for redressal of their grievance.

In the meantime the police shall continue their surveillance over the area in order to avoid any untoward incident and shall ensure maintenance of peace and tranquility.

The writ petition is disposed of.

There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
