... Petitioners Mr. Tapodip Gupta ....for the petitioners Mr. Ranabir Roy Chowdhury Ms. Subhasish Datta ....for the State Learned advocate appearing for the petitioners submits that petitioners along with other were arrested allegedly for recovery of 354 bottles of phensedyl.
It has been submitted that petitioners are in custody for more than 6 months and although charge-sheet has been submitted but charges are yet to be framed.
Learned advocate for the State opposes the prayer for bail and submits that the petitioners were found to be in possession of the contraband so recovered.
I have taken into account the quantum of seizure as well as the period of detention of the petitioners and on an assessment of the same, I am of the view further detention is unwarranted.
Accordingly, the petitioners are released on bail. Petitioners shall furnish a bond of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Judge, Special Court (under NDPS Act)-cum-Additional 4th Court, Malda.
If on bail, the petitioners shall be physically present on each and every date before the learned trial Court in seisin of the case. The petitioner shall not leave the jurisdiction of district of Malda without the prior permission of the learned Special Court.
Accordingly, CRM (NDPS) 1605 of 2025 is allowed. All parties shall act in terms of server copy of this order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
