Learned advocate for the petitioner submits that despite order passed by the Court on 10th June, 2024 the private respondents are not permitting the petitioner to enter into the house.

The aforesaid allegation is denied by the learned advocate representing the private respondents. It has been submitted that a portion of the property was gifted by the mother in their favour. The private respondents do not have any issue with the mother. Their allegation is with the father.

The mother shall be permitted to use the room, verandah used as a kitchen and the wash room of the first floor of the subject property. The private respondents are restrained from disturbing her possession over the aforesaid portions without any order from the competent Court.

The police are directed to ensure that there is no breach of peace in the locale and the life and property of the petitioner is not endangered in the hands of the private respondents.

Supplementary affidavit filed in Court today is kept with the records.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
