The revisional application has been preferred against the order dated 30.08.2025 passed by the learned Additional District and Sessions Judge, 2nd Fast Track Court, Barasat, North 24 Parganas in Criminal Revision 140 of 2018, dismissing the revisional application and affirming the order dated 04.07.2018 passed by the learned Judicial Magistrate, 2nd Court, Barasat, North 24 Parganas in Maintenance case No. 4 of 2015. 2.
In course of hearing, learned counsel appearing for the petitioner has made out very reasonable prayer stating that the Trial Court may be directed to be proceed expeditiously with the Misc. case filed before the learned Trial Court by the minor child of the parties.

It appears that the child has claimed maintenance from mother who admittedly works in a Government job. The father prima facie appears to be engaged as a security guard with a bank.

The learned Trial Court and the Appellate Court did not find any urgency in the matter. Admittedly, affidavit of assets and liabilities have not been filed before the learned Trial Court. 5.
Considering the nature of relief as prayed for, service in the present case is dispensed with and the criminal revision is disposed of with the direction that the trial Court shall direct both the parties to file their affidavit of assets and liabilities before the learned Trial Court within days from the date of communication of this order.

The Trial Court on filing of the affidavit of assets and liabilities keeping in mind the guidelines of the Hon'ble Supreme Court in cases of such nature shall proceed to dispose of the Misc. case expeditiously preferably within three months from the date of this order.

The order challenged before this Court relates to interim maintenance but as the matter is not being heard on merit, the Trial Court shall make all endeavor to dispose of the Misc. case finally without being influenced by the interim order passed by Trial Court and the order passed in appeal.

Accordingly, the revisional application stands disposed of. 9.
