The petitioner has challenged the order dated 4th October, 2024 passed by the learned District Judge, Fast Track, 2nd Court, Contai, Purba Medinipore in Matrimonial Suit No.270 of 2024. By the said order the learned trial judge after recording that no Service Returns and Acknowledgement Due Card in respect of the opposite party in the matrimonial suit have been received, fixed 12th February, 2025 for Service Returns and Acknowledgement Due Card.

Learned advocate appearing for the petitioner submits that he has documents to show that summons of the suit has been duly served upon the respondent in the matrimonial suit. It does not appear from the order sheet that such document was placed before the learned trial Judge.

CO 4094 of 2024 is disposed of by giving liberty to the petitioner to produce the materials/documents in support of his claim that the summons of the suit has been served upon the respondent in the

matrimonial suit. If such documents are placed before the learned trial judge, the same shall be considered and an order be passed as to whether summons have been served upon the respondent in the matrimonial suit or not.
