Saha ... for the Petitioner(s) Mr. Iqbal Kabir Mr. Sarthak Mondal ... for the State-respondent(s) Learned advocate for the petitioners submits that earlier, in CRM (NDPS) 326 of 2025, there was a direction by a Co-ordinate Bench of this Hon'ble Court to conclude the trial within a period of six months. However, within the said period, the trial was not over and one of the accused approached the Hon'ble Apex Court.

According to the learned advocate, in a Special Leave to Appeal (Crl.) No. 11620 of 2025, it was recorded that as the trial was at the fag end and was fixed on 01.11.2025 for recording the evidence of the last prosecution witness, no interference was called for, as such, the bail was not granted.

Learned advocate for the petitioners again submits that although dates were fixed on 01.11.2025 and

21.11.2025, but, for absence of the witnesses, proceedings in the trial could not progress.

Learned advocate for the State opposes the prayer for bail and submits that the evidence of the last witness is to commence and the next date is fixed on 18th December, 2025.

In view of the submissions advanced by the State and the next date being fixed on 18th December, 2025, the investigating officer of the case who is appearing on dock, will appear before the learned Special Court on 18th December, 2025 and the learned Special Court will continue with the evidence of the witness till the examination-in-chief and cross-examination is over.

The learned trial court would by 31st January, 2026 complete the examination under section 313 of the Cr.P.C., thereafter, pronounce its verdict at the appropriate stage after the arguments are over.

Having considered the overall circumstances of the case, I am not inclined to enlarge the petitioners on bail. Hence, the prayer for bail of the petitioners is Rejected.

Accordingly, CRM(NDPS) 1620 of 2025 is dismissed. Pending application(s), if any, is also disposed of. The learned Registrar General, High Court, Calcutta is directed to communicate this order to the learned trial

court through the learned District & Sessions Judge, Paschim Bardhaman.
