Case No. 994 of 2019). And In Re :

Learned advocate appearing for the petitioner submits that the petitioner is in custody for 3 years 9 months and not a single witness till date has been examined, although the prosecution has relied upon 13 witnesses.

So far as the merits of the case regarding trafficking and sexual exploitation outside the State of West Bengal is concerned, the same was expressed by the High Court in CRM (DB) 2670 of 2022. As such, no further comments are made on the merits of the case which may prejudice either of the side. However, there is a difference between merits of a criminal case and the progress of the trial case. Having considered the fact that substantial time has lapsed, as a matter of last chance, six months' time is

granted to the prosecution to conclude the prosecution witnesses.

The Additional S.P., Kakdwip will monitor the availability of all the witnesses on the dates so fixed by the learned Trial Court.

In view of the petitioner being in custody for such long period of time, the learned Trial Court would on and from the next date fix on priority, the present sessions trial. At this stage, the prayer for bail of the petitioner is rejected.

Petitioner will renew his prayer for bail after the aforesaid period is over.

With the aforesaid observations, the application for bail, being CRM (M) 2661 of 2025, is disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
