Learned advocate appearing for the petitioner submits that the petitioner being a driver has been detained for alleged recovery of 800 bottles of PHENSEDYL. It has also been contended that the petitioner is in custody for 182 days. Learned advocate for the State opposes the prayer for bail and submits that the petitioner is the owner of the vehicle against whom harsher process has been imposed and chargesheet has already been submitted. Having considered the stage of the case, I am not inclined to release the petitioner on bail. The learned Trial Court is directed to expedite the process against the accused/petitioner.
However, the trial court is directed to split up the trial As such, the prayer for bail of the petitioner being CRM (NDPS) 1606 of 2025 is dismissed at this stage. The petitioner shall be at liberty to renew the prayer for bail after the stage of consideration of charges is over. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
