AKG (Rejected) CRM (NDPS) 1607 of 2025 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with NDPS case no. 67 of 2024 arising out of Dhubulia Police Station case no. 285 of 2024 dated 03.08.2024 under Sections 20 (b)(ii)(C)/25/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 and subsequently Charge Sheet under Sections of the Narcotic Drugs and Psychotropic Substances Act.

Learned advocate appearing for the petitioner submits that the petitioner is a helper of a truck, who has been implicated in connection with the instant case for the alleged offence of recovery of 55 Kg. Ganja. It has been claimed that the contraband articles were recovered from different location. Investigation has been completed. The petitioner is in custody for 16 months, as such on any stringent condition the petitioner may be released on bail Learned advocate for the State opposes the prayer for bail and submits that commercial quantity of contraband articles has been seized, harsher process of law has been imposed and charge-sheet has already been submitted.

Be that as it may, since commercial quantity of contraband articles have been seized and assessing the complicity of the present petitioner, I am not inclined to enlarge the petitioner on bail at this stage.

As such, the prayer for bail of the petitioner being CRM (NDPS) 1607 of 2025 is dismissed at this stage. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
