Mr. De, learned advocate appearing for the petitioner submits that he may be allowed to file an application under Section 311 of the Code of Criminal Procedure in consonance with the settled proposition of law. There is no dispute regarding the findings of the learned Magistrate as well as the learned Additional Judicial Magistrate, 4th court, Paschim Medinipore in its order dated August 8, 2023 in connection with Criminal Revision No. 321 of 2023 that the application under Section 311 of the Code of Criminal Procedure so filed was wanting materials for interference by the court to exercise its jurisdiction. Liberty is granted to the petitioner to take out an application under Section 311 of the Code of Criminal Procedure. The learned Magistrate would decide the same in accordance with law if the said application is such that the requisites are satisfied and the same is required for the ends of justice. With the aforesaid observations, the revisional application being CRR 4632 of 2023 is disposed of.
