Case No. 19 of 2025 arising out of Sagarpara Police Station case No. 122 of 2025 dated 06.02.2025 under Section 21(c)/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985. Learned advocate appearing for the petitioner submits that the petitioner has been implicated in connection with the instant case on the basis of statement of a co-accused and the principal accused. One of whom, against whom seizure has been effected, has already been granted bail, as such, the petitioner may be released on bail on any stringent condition. Learned advocate appearing for the State submits that the subject matter of the case relates to 180 bottles of Choco cough syrup codeine phosphate hydrochloride syrup and it is also submitted that the petitioner has an antecedent. Records of the case reflects that the petitioner is in custody from 22nd July, 2025. The petitioner has been implicated on the basis of statement of co-accused.

Having considered the fact that the other accused has been released on bail, I am inclined to allow the petitioner on bail.

As such petitioner namely, Asadul Sk @ Asadul Islam shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Judge, Special Court under NDPS Act-cum-Additional Sessions Judge, 5th Court, Berhampore, Murshidabad. If on bail, the petitioner shall be physically present on each and every date before the learned trial Court in seisin of the case. The petitioner shall not leave the jurisdiction of district of Murshidabad without the prior permission of the learned Special Court.

Accordingly, CRM (NDPS) No. 1608 of 2025 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
