1. Learned counsel for the petitioner alleges that the petitioner sought a new electricity connection which was refused by the Calcutta Electric Supply Corporation Limited (CESC Limited) on the ground of apprehended splitting of load.

2. It is argued by the petitioner that such ground is not tenable in the facts of the case.

3. Such contention is disputed by learned counsel for the CESC Limited, who also points out that as per the extant regulations, the dispute ought to have been raised before the concerned Grievance Redressal Officer (GRO).

4. There is substance in the contention of the CESC Limited regarding availability of an equally efficacious alternative forum.

5. Accordingly, W.P.A. No. 27395 of 2023 is disposed of by granting liberty to the petitioner to approach the concerned GRO with the remedy sought in the present writ petition.

6. If so approached, the GRO shall decide the said dispute within six weeks from the date of communication of this order to the said GRO, in accordance with law and upon giving opportunity of hearing to all concerned.

7. There will be no order as to costs.

8. Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance of all necessary formalities.
