Notice inviting e-tender by the Gram Panchayat is impugned in the instant writ petition at the instance of two of the members of the Gram Panchayat.

Allegation is that the Prodhan could not have published the notice inviting e-tender. Further allegation is that the tender document was not published in the local newspapers. Learned advocate representing the Panchayat and its Prodhan denies the allegation of the petitioners. It has been submitted that there was due publication of the tender document in the local newspapers and the Prodhan did not float any tender in his individual capacity. The Prodhan being the Sanchalak of the Upa-Samity has floated the tender in question.

From the submission made on behalf of the parties, it does not appear that there is any illegality or irregularity which is required to be interfered with at this stage. In view of the above, the writ petition fails and is hereby dismissed.

Urgent certified copy of this order, if applied for, be supplied to the parties expeditiously, on compliance of usual legal formalities.
