Adv., Ms. Sudeshna Das ... ...For the State The prayer for bail on the ground of parity in view of inter alia order dated October 3, 2024 passed in C.R.M. (DB) 2309 of 2024 is not being disputed on behalf of the State. Several co-accused were granted bail from time to time by Coordinate Benches. One of such order is October 3, 2024 passed in C.R.M. (DB) 2309 of 2024.

In such circumstances, on the ground of parity, we extend the same facility to the petitioner.

Accordingly, we direct that the petitioner shall be released on bail upon furnishing a bond of Rs. 10,000/- (Rupees Ten Thousand only), with two sureties of like amount

each, one of whom must be local, to the satisfaction of the Learned Additional Chief Judicial Magistrate, Lalbagh, Murshidabad, subject to condition that the petitioner shall appear before the learned trial court on every date of hearing until further orders and shall not intimidate witnesses and/or tamper with evidence in any manner whatsoever and on further condition that the petitioner while on bail shall not leave the concerned police station and shall meet the officer in charge of the concerned Police Station once in a week until further orders..

In the event, the petitioner fails to comply with the conditions as enshrined hereinbefore, it is open to the trial court to cancel the bail without further reference to this Court. The prayer for bail of the petitioner is allowed. C.R.M.(DB) 4038 of 2024 is disposed of.
