For the petitioners This revisional application is filed by the defendant nos.2 and 3 under Article 227 of the Constitution of India for expeditious disposal of Title Suit No.101 of 2015 pending before the learned Civil Judge (Junior Division), 2nd Court at Purba Bardhaman.
The brief fact of the case is that the plaintiff filed a suit for permanent injunction along with other reliefs. In the said suit, the petitioners-defendants filed their written statement. Thereafter, several dates were fixed for framing of issues. For expeditious hearing of the suit the petitioners-defendants have filed the present revisional application.
Mr. Shyamal Chakraborty, learned Advocate for the petitioners submits that the suit dates back to the year 2015 and though written statement has been filed but issues are yet to be framed. He submits for a direction for expeditious hearing of the suit.
It is found that the suit has been filed in the year 2015. Further, several dates were fixed for framing of the issues. It is informed that the issues are yet to be framed.
In the aforesaid backdrop and also bearing in mind the age of the suit, it needs to be heard expeditiously.
Accordingly, the learned Trial Court is directed to dispose of the suit as expeditiously as possible without granting any unnecessary adjournment to either of the parties.
Petitioners are directed to communicate this order to the learned Court below as well as the plaintiff and his learned Advocate appearing in the court below. With the aforesaid observation, this revisional application being C.O. 3868 of 2022 stands disposed of. All connected applications, if any, stand disposed of.
Interim order, if any, stands vacated.
Urgent photostat copy of this order be given to the parties upon compliance of necessary legal formalities. (Bivas Pattanayak, J.)
