The limited grievance of the petitioner is that despite a transformer having been installed, thereby blocking the ingress and egress of the petitioner by the West Bengal State Electricity Distribution Company Limited (WBSEDCL), the representation of the petitioner in that regard has not yet been decided by the WBSEDCL.

Such contention is controverted by learned counsel for the WBSEDCL, who submits that the installation-in-question is not a transformer, but a Ring Main Unit (RMU).

It is further submitted that the same has been installed not on the path of the petitioner but on a KMC land.

Be that as it may, since the WBSEDCL has not yet decided on the representation of the petitioner and the petitioner has sought only for consideration of the same, WPA No. 28154 of 2022 is disposed of by directing the Divisional Engineer, Garia, Mahamaya Tala E.S., Kolkata700 084, that is, the respondent no. 3 herein to consider the representation of the petitioner dated January 20, 2021 (Annexure - P2 at page 12 of the writ petition) upon giving an opportunity of hearing to the petitioner as expeditiously as possible, positively within four weeks from date and to convey the decision of the WBSEDCL immediately thereafter to the petitioner.

It is clarified that the respective contentions of the parties have not been gone into by this Court on merits.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
