CAN No.1 of 2025 has been filed for restoration of the writ petition dismissed for default by the last order dated February 25, 2025.

After hearing the parties and considering the reason stated in the application, I allow the same by restoring the writ petition to its original file and number.

The petitioner prays for a direction upon the Block Development Officer and the Block Land & Land Reforms Officer to take steps in terms of the direction passed by the District Welfare Officer, Backward Classes Welfare and Tribal Department, Nadia dated March 6, 2024.

The petitioner claims to be a member of the tribal community. His allegation is that the private respondents are forcibly occupying the tribal land. The District Welfare Officer has requested

the BDO and BL&LRO, Chakdah to cause an inquiry and take necessary action. The same has not been done till date.

After hearing both the parties and perusing the documents placed before this Court, I dispose of the writ petition by directing the BDO and the BL&LRO, Chakdah to consider and dispose of the complaint lodged by the petitioner alleging forcible occupation of tribal land by passing a reasoned order in accordance with law, after giving a reasonable opportunity of hearing to all the necessary parties at the earliest but positively within a period of twelve weeks from the date of communication of this order.

If it is found that any portion of the tribal land has been forcibly occupied as alleged by the petitioner, then necessary remedial steps shall be taken.

Report dated February 25, 2025 filed in Court be taken on record.

Affidavit of service is also be taken on record. 9.

The writ petition and the connected application both stand disposed of.

10.

All parties are to act on the server copy of this order duly downloaded from the official website of this Court.

Certified copy of this order, if applied for, shall be made available to the parties.
