APP Mr. Sunil Gupta ... for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner is in custody for more than a year and chargesheet has already been submitted. Learned advocate also submits that the petitioner has been implicated at the behest of the relations of her matrimonial home and she is innocent of the charges.
Mr. Gouranga Kr. Das along with a junior of his choice appears on behalf of the State as per the direction of this court. The appointment of both Mr. Das and the junior of his choice, if any, may be regularized by the concerned authority.
Learned advocate for the State has drawn the attention of the court to the postmortem report; the statement of the witnesses under Section 164 of the Cr.P.C.
as well as the evidence of the neighbours under Section 161 of the Cr.P.C.
I have taken into account the facts of the case which primarily seems to be based on circumstantial evidence. Having considered the same, I am of the view that the petitioner may be enlarged on bail.
Hence, the prayer for bail of the petitioner is Allowed.
Accordingly, the petitioner viz, Rupa Ghosh shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the Learned ACJM, Kalyani, Nadia.
If on bail, the petitioner shall also make herself physically available on each and every date so fixed by the learned trial court and shall not leave the district of Nadia without prior permission of the learned trial court. Accordingly, CRM (M) 2665 of 2025 is allowed. Memo of Evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
