1. Affidavit of service filed in Court, is taken on record.

2. The petitioner is a permanent stage carriage permit for plying a vehicle (bus) on the stage carriage route Hijli Sarif to Mecheda via Silaberia, Vidyapith Heria, Nandakumar, Tamluk.

3. The said permanent stage carriage was granted by the respondent no.2 on 19.2.2019 for five years i.e.

up to 18.02.2024.

4. The said permit has been renewed for further period of five years, i.e. up to 18.02.2029. On the strength of the permit, the petitioner is operating his vehicle

bearing no. WB-19E-6587 on the said route as per the approved time table.

Main grievance of the petitioner is that already an application has been made before the authority concerned i.e. respondent no.2 on 22.3.2022 for variation of the said route for plying his vehicle on the route alignment of Hijli Sarif to Mecheda via Nandakumar by touching National Highway (NH-41) instead of Tamluk but the same remains pending for consideration.

Heard the parties and on the basis of the available materials on record, this Court is of the view that the respondent no.2 is directed to consider the representation dated 22.03.2022 being annexure p-3 a t page-18 to the writ petition within a period of sixty days and shall pass a reasoned order in accordance with law upon affording an opportunity of hearing to the petitioner and communicate such decision within a week thereafter.

7. With the above observations and directions, the writ petition, WPA 28064 of 2025 stands disposed of without going into the merits of the case.

8. It is needless to mention that in the event if the petitioner is found to be fit and eligible to ply his vehicle in respect of the route by touching NH 41 instead of Tamluk, the authority concerned shall forthwith make necessary endorsement on the permit for the variation of the route.
