Anwar Hossain Mr. Abhishek Verma ... for the State Learned counsel appearing on behalf of the petitioner submits that the petitioner's sister had earlier lodged a complaint against the de facto complainant/her husband regarding matrimonial disputes. As a counter case, the present FIR has been initiated and the principal accused has already been granted bail.

Learned counsel appearing on behalf of the State strongly opposes the prayer for anticipatory bail and submits that the present petitioner, along with his brother, assaulted the victim with fists, blows and bamboo sticks, causing grievous injuries. He relies on the injury report, which discloses a fracture injury on the forearm of the victim. Considering the above and the other incriminating materials available in the case diary, I am not inclined to grant anticipatory bail to the present petitioner Israfil Mandal.

The application for anticipatory bail is, thus, rejected. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
