The instant revisional application has been filed on behalf of the petitioners seeking quashing of an order dated November 06. 2024 by the learned Additional Chief Judicial Magistrate, Haldia. By such order, the learned Magistrate issued warrant of arrest against the present petitioners.
It is submitted by the learned Advocate for the petitioners that the petitioner were granted anticipatory bail. By virtue of such anticipatory bail granted to the petitioners, the petitioners surrender before the learned Additional Chief Judicial Magistrate, Haldia and they were released on bail.
It is also submitted that petitioners have been attending the Court regularly being released on bail. On November 6, 2024, by the impugned order, warrants of arrest were directed to be issued against the petitioners as they failed to appear before the learned Magistrate on the date fixed. The issuance of warrant of arrest was challenged by the petitioners in other revisional application CRR 5187 of 2024 which was disposed of by an order dated February 24, 2025. By such order, the coordinate bench stayed the warrant of arrest issued as against the petitioners and extended the time to surrender before the learned Additional Chief Judicial Magistrate
within 10 days of the order.
Learned Advocate for the petitioners further submits that in terms of order dated February 24, 2025 passed in CRR 5187 of 2024 the petitioners could not surrender.
The learned Advocate for the petitioners submits that the petitioners could not surrender before the learned Trial Court as one of them was suffering under some medical conditions. Having heard the submissions made on behalf of the petitioners, on the perusal of the medical documents annexed with the application and for ends of justice, time to surrender is extended for the period of seven days hence.
Upon their surrender the learned Additional Chief Judicial Magistrate, Haldia will consider the applications of bail, if any, file by the petitioner in accordance with law. In the event, the petitioners fail to surrender before the Jurisdictional Court within the time fixed, the learned Jurisdictional Court shall be at liberty to take appropriate legal steps against the petitioners in accordance with law.
With such observation CRR 5309 of 2025 is disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (MD. SHABBAR RASHIDI, J. )
