Learned counsel for the petitioner submits that the petitioner is in custody for 170 days. Charge sheet has been submitted. The complaint demonstrates that the alleged offence was committed by a lame person. The petitioner is not lame.

Referring to the memo of evidence, learned counsel for the State submits that the accused/petitioner has committed the same offence within a span of six (6) days. He has been identified by one of the witnesses in TI Parade. Considering the material on record as well as the nature of offence, I am not inclined to release the petitioner on bail at this stage.

The prayer for bail be rejected.
