This is an application praying for a direction upon the learned Civil Judge, Senior Division, 1st Court at Barasat to dispose of pending applications in connection with Title Suit No.533 of 2021.

Learned advocate appearing for the petitioner submits that an application under Order 39 Rule 1 and 2 read with Section 151 of the Civil Procedure Code and an application under Order 1 Rule 10 read with Section 151 of the Code of Civil Procedure are pending and a direction should be passed to dispose of the same expeditiously.

After going through the order sheets this Court finds that the learned trial Judge has fixed 28th January, 2025 for hearing of the applications under Order 1 Rule 10 of the Code of Civil Procedure. In view thereof, CO 4096 of 2024 is disposed of by requesting the learned Civil Judge, Senior Division,

1st Court at Barasat to take up hearing of the application under Order 1 Rule 10 read with Section 151 of the Civil Procedure Code on the next date i.e. 28th January, 2025 if the same is otherwise ready for hearing and dispose of the same as expeditiously as possible. After disposal of the application under Order 1 Rule 10 the learned trial Judge is requested to make an endeavour to dispose of the application under Order 39 Rule 1 and 2 read with Section 151 of the Code of Civil Procedure expeditiously if the same is otherwise ready for hearing.
