Petitioner was aggrieved by the fact that his son expired because of an accident which was a consequence of a drunken driving by one Sk. Bapan. Petitioner was aggrieved also that no case was registered by the police authorities.

However, learned advocate for the state has submitted a report which reflects that Uluberia Police Station Case No. 278/2024 dated 17.07.2024 was registered for investigation under the relevant sections of law.

So far as the preliminary grievance of the petitioner is concerned, the same remains satisfied. However if petitioner is dissatisfied with the manner

of investigation particularly with regard to the nature of the offences alleged by the police authorities, petitioner would be at liberty to take out an appropriate application before the learned Jurisdictional Magistrate.

Learned Jurisdictional Magistrate would consider the same in its perspective and pass necessary orders.

With the aforesaid observations WPA 28469 of 2024 is disposed of.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
