The writ petition is at the instance of the bank seeking direction upon the District Magistrate, South 24 Parganas to take steps under Section 14 of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002.

The said Section 14 application was filed before the District Magistrate pursuant to the leave granted by the Debts Recovery Tribunal, Kolkata in S.A No.130 of 2016 (Annexure P5, p.25) on August 22, 2024.

After hearing the respective submissions made by the parties, I dispose of the instant writ petition by directing the District Magistrate to take steps to consider and dispose of the said application filed by the bank under Section 14 of the Act in accordance with law at the earliest, but positively within thirty days from the date of communication of this order.
