Kausik (Rejected) CRM (NDPS) 11 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Lalgola Police Station Case No. 819 of 2024 dated 05th of August, 2024 under Section 21(C)/29 of the NDPS Act, 1985.

Petitioner has prayed for bail as he is in custody since 04.08.2024. According to the petitioner witness action has started and the same is not supporting the prosecution version. Learned advocate for the State has produced the case diary and has drawn the attention of the Court to the seizure list which reflects that recovery of 500 Gms of Heroin were effected from this petitioner and he has other antecedents also. Having considered the locus of the present petitioner, I am of the opinion that the rigors of Section 37 of the NDPS Act is attracted and petitioner is not enjoying the same locus as the other accused person who has been granted bail.

Having considered the same, CRM (NDPS) 11 of 2026 is dismissed.

Case diary be returned to the learned advocate for the State.
