The petitioner is an Assistant Teacher at Gopalpur Free Primary School, a school under Ketugram West Circle of Purba Bardhaman District Primary School Council. The petitioner is praying transfer to any school in the district of Nadia, his home district.

The District Primary School Council, Purba Bardhaman, the respondent no.6 herein was directed to file a report disclosing as to whether the petitioner is a surplus teacher in his present school as alleged.

Mandal, learned Advocate for the respondent no.6 submits that already a general report has been filed wherefrom it would appear that the petitioner is a surplus teacher.

Mr. Sutradhar, learned Advocate for the petitioner submits that the prayer of the petitioner for transfer to his home district if cannot be considered, at least his prayer for transfer to any school under the Purba Bardhaman District Primary School Council may be considered.

The petitioner is granted liberty to apply before the respondent no.6 praying transfer to any school under the said Council, preferably to a school nearear to his residence where there is shortage of teacher and if such prayer is made, the said Council shall consider the same in accordance with law. WPA 28657 of 2024 is disposed of without any order as to costs.
