1. Nobody appears on behalf of the appellant/convict.

2. State is represented by the learned advocate.

3. The instant appeal is filed on behalf of the appellant/convict challenging the impugned judgment and order of conviction dated 20.1.2016 and 21.1.2016 passed by the learned Additional District & Sessions Judge, 2nd Court, Tamluk, Purba Medinipur in connection with S.T. No. 07(09)/2014 and corresponding to S.C. No. 01 (November)/2013 arising out of Moyna Police Station Case No. 161/2013 dated 21.08.2013 wherein this appellant/convict was found guilty for commission of offence punishable under Section 10 of the Protection of Children from Sexual Offences Act, 2012 and he was sentenced to suffer R.I. for six years along with a fine and in default of payment to suffer further S.I. for one and half years.

In pursuance of the direction passed by this Court dated 11.4.2025, a report is submitted by the Superintendent, Midnapore Central Correctional Home indicating that the said appellant/convict was released on 17.6.2020 after expiry of sentence, after getting benefit of UT set off and having earned remission and after paying the fine amount.

5. As the sole appellant/convict had already served out the substantive sentence as passed by the learned Trial Court in the impugned judgment and order of conviction, the instant appeal is liable to be dismissed.

6. Accordingly the instant appeal be and the same is hereby dismissed on merit.

7. The impugned judgment and order of conviction passed by the learned Trial Court dated 20.1.2016 and 21.1.2016 passed in connection with S.T. No. 07(09)/2014 corresponding to S.C. No. 01(November)/2013 is hereby affirmed.

8. Let a copy of this order along with TCR be sent down to the learned Trial Court immediately.

9. Urgent photostat certified copy of the order, if applied for, be given to the parties upon complying with all legal formalities. (Prasenjit Biswas, J.)
