22.12.2022 sdas rejected C.R.M. (NDPS) No. 1517 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Golabari Police Station Case No. 217 of 2019 dated 12.06.2019 under Sections 20(b)(ii)(C )/3/29 of the NDPS Act.

And In Re : Pradip Ruidas ..... petitioner Mr. Mrityunjoy Chatterjee Mr. Debapriya Majumder ... for the petitioner Mr. Saibal Bapuli, learned APP Mr. Bibaswan Bhattacharya ... for the State Heard the learned Counsels appearing for the parties. We have considered the materials on record. Petitioner is in custody for more than three years. Narcotic substance above commercial quantity was recovered from the joint possession of the petitioner and co-accuseds. Under such circumstances and in view of the statutory restrictions under Section 37 of the NDPS Act, we are not inclined to grant bail to the petitioner.

The application for bail is, thus, rejected.

On the score of inordinate delay in trial we note three witnesses have already been examined.

Under such circumstances, trial court is requested to conclude the trial as expeditiously as possible preferably within one year from the

next date fixed for recording of evidence without granting unnecessary adjournment to either of the parties. (Ajay Kumar Gupta, J.) (Joymalya Bagchi, J.)
