Petitioners by presenting this writ petition have made an attempt to lay claim of appointment in consideration of their participation in 2020 recruitment process for filling up the post of primary teachers conducted by West Bengal Board of Primary Education (for short, "Board").
During course of hearing, Mr. Biswas, learned advocate representing the Board has placed before this Court a judgment delivered by
the Hon'ble Supreme Court on 9th May, 2024, reported in 2024 SCC OnLine SC 1189 (Ali Hossain Mandal & Ors, Vs. West Bengal Board of Primary Education and Ors.). It is submitted that the judgment of the Hon'ble Supreme Court pertains to same selection process of 2020 wherein it has been unequivocally observed in paragraph 29 that final Merit List was notified on 15th February, which stood extinguished after expiry of one year on 15th February, as per Rule of the Recruitment Rules, 2016. No extension by any competent authority was granted to 15th February, 2021 panel and therefore no relief was granted to the candidates who approached the Court in May, 2022, i.e., long after the panel stood extinguished. It was also observed in paragraph 29(iv) that no further appointment is permissible from the recruitment process initiated on 23rd December, 2020 when a fresh recruitment process has commenced.
In view of the observations made by the Hon'ble Supreme Court in the judgment dated 9th May, 2024, no relief can be granted to the petitioners.
Writ petition stands dismissed.
