Mr. Swarup Paul Mr. Guru Saday Dutta Mr. Anish Roy ..for the petitioners Learned advocate appearing on behalf of the writ petitioners makes over to the Court a written instruction received from the petitioner no.1 dated 15th April, 2024. The written instruction is taken on record. On a perusal of the said written instruction it appears that the petitioner no.1 being a Nursing Home has been permanently closed in 2020. The petitioner no.1 has cleared all its dues till the closing of the nursing home. There is no dues on account of Employees State Insurance Corporation according to the petitioner. It is also stated that in view of such closing down of the nursing home the writ petition has become infructuous.

No one appears on behalf of ESI authorities despite they are being served with a notice through the

department to oppose the submission that there is no dues on account of ESI as of now as against the petitioners.

In the aforesaid facts and circumstances, the writ petition is disposed of, on having become infructuous with the passage of time.

Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance of all necessary formalities.
