Report dated 12.01.2024 submitted by Mr. Ganguly, learned advocate appearing for the State be kept with the record.

The said report has been submitted by the Superintendent of Police, Basirhat Police District pursuant to the earlier order passed by this Court on 12.12.2023. It has been submitted that two witnesses have been examined till date out of seven witnesses cited by the prosecution. Five more witnesses are yet to be examined. The petitioner is in custody for about 20 months as submitted by the learned advocate appearing for the petitioner.

The learned trial court would fix a schedule consisting of three dates and fix such schedule once in every month so that at the earliest, rest of the five witnesses are examined. No unnecessary adjournment be granted to any of the parties.

The Superintendent of Police, Basirhat Police District be informed in case any witness is not appearing on the scheduled/fixed date. The office of the Superintendent of Police, Basirhat Police District will immediately respond to

the court and take steps to ensure that the concerned witness is made available.

Learned public prosecutor conducting the case would ensure regarding the production of materials, documents and exhibits on the dates so fixed for examination of the witnesses.

All stakeholders would cooperate with the learned trial court to conclude the trial at the earliest.

With the aforesaid observations, the revisional application being CRR 4649 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
