It is submitted on behalf of the appellant that during the pendency of this appeal, the award in favour of the claimant has been executed and the entire claim amount has been withdrawn.

In view of the subsequent development, FMAT 1278 of 2016 stands dismissed.

The point of law involved in this matter pertains to the driving licence of the driver of an offending vehicle has since been adjudicated upon by the Hon'ble Supreme Court in the decision reported in 2017 (14) SCC 663. The statutory deposit of Rs.25,000/- paid by the appellant at the time of filing of the appeal be refunded to the appellant along with interest within a period of 4 weeks from the date of this order.

With the aforesaid directions CAN 1 of 2017 is also disposed of.
