Bhattacharya Mr. Anindya Lahiri Ms. Sumita Sen ............ for the respondents Learned counsel for the petitioner submits that there are some incurable defects in the present writ petition and his client would like to withdraw this writ petition and file appropriate application/applications afresh on the self-same cause of action.

Learned counsel for the private respondents points out that so far as Shantiniketan PS Case No.135 dated 31.08.2023 is concerned, the petitioner has already filed a criminal revision and failed to obtain an interim order of stay.

At this stage, learned counsel for the petitioner submits that the purported non-mentioning was a bona fide mistake, but the petitioner was granted an interim of no coercive steps.

On the prayer of the learned counsel for the petitioner, the writ petition is dismissed as withdrawn.

However, this order shall not preclude the petitioner from filing proper application/applications afresh on the self-same grounds.

It is clarified that the merits of the case have not been gone into.

Urgent certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
