In spite of service of notice upon authority of Bagmundi High School (HS), Purulia being respondent nos. 6 and 7, those respondents are not represented today.
However, State respondents and West Bengal Central School Service Commission are represented by learned advocates.
It is submitted on behalf of the petitioner that an application was made on Utshasree portal seeking transfer on self-medical ground and same was forwarded by the aforesaid school authority to the concerned Block Medical Officer of Health for obtaining medical report on
medical verification of the petitioner. Concerned Block Medical Officer of Health furnished a report on 14th June, 2022 which is at page 74 of the writ petition. According to the petitioner, said report dated 14th June, 2022 supports petitioner's transfer on medical ground.
However, it is submitted that thereafter no steps have been taken by the aforesaid school authority by forwarding transfer application to the District Inspector of Schools (SE), Purulia for taking further steps. Petitioner prays for direction upon the concerned respondent authorities to process her transfer application since same is pending for a long time before the aforesaid school authority.
Having considered the case made out in this writ petition, the authority of Bagmundi High School (HS), Purulia being respondent nos. 6 and 7 are directed to forward transfer application of the petitioner along with report of the concerned Block Medical Officer of Health dated 14th June, 2022 to the District Inspector of Schools (SE), Purulia by fortnight from the date of communication of this order. On receipt of transfer application, concerned District Inspector of Schools shall obtain report from the concerned Chief Medical Officer of Health on
medical verification of the petitioner by fortnight thereafter. If medical report which is to be obtained from the concerned Chief Medical Officer of Health justifies transfer of the petitioner, the District Inspector of Schools (SE), Purulia shall forward transfer application of the petitioner along with medical report to the concerned authority of West Bengal Central School Service Commission by three weeks thereafter. If Chairman of the Commission being respondent no. 4 receives documents from the concerned District Inspector of Schools, the Chairman of the Commission shall decide transfer application by six weeks thereafter and decision to be taken by respondent no. 4 shall be communicated to the petitioner by two weeks thereafter.
However, transfer application of the petitioner shall not be rejected on the ground of suspension of Utshasree portal.
Leave is granted to the petitioner to amend the cause title and add District Inspector of Schools (SE), Purulia as additional respondent in course of this day.
Service of notice upon the District Inspector of Schools (SE), Purulia is dispensed
with since the State respondents are represented by the learned advocate today.
Writ petition stands disposed of.
There shall be, however, no order as to costs.
Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertakings.
