The present revisional application has been preferred for transfer from the court of the learned CJM, Howrah to any court at Birbhum. The reasons so assigned is the minor daughter whose care is to be tendered by the present petitioner. I have also taken into account the chargesheet which has been submitted which reflects that all the witnesses save and except one are from the area of Santragachi, Howrah. The transfer in such cases is bound to jeopardize the whole of process of trial. Accordingly, the prayer for transfer is refused. However, the petitioner would be entitled to apply under Section 205 of the Code of Criminal Procedure. The learned trial court in connection with Santragachi P. S. Case No. 71 dated 29-08-2020 will consider such application in accordance with law and on usual undertaking if it satisfies allow such prayer by imposing conditions. With the aforesaid observations, the revisional application being CRR 4657 of 2023 is disposed of.

Pending applications, if any, are consequently disposed of.
